An Overview of H1B Visa – Employer Based Petitions

Working overseas is a popular option for people looking for more competitive job and remuneration package. The United States of America is one of the most popular countries people go to for work aside from the Middle East, Europe, Australia and Canada. US government offers employer based petitions depending on the degree of skills and expertise a person belongs to.

Here are the five categories for employer based immigration:

a)       First Preference – persons of extraordinary ability, outstanding professors or researchers and multinational executives

b)       Second Preference – persons with advanced degrees or exceptional ability

c)       Third Preference – professionals, skilled workers and others workers

d)       Fourth Preference – persons belonging to religious organization

e)       Fifth Preference – employment creation investors

In order to hire employees from foreign countries, an employer is required to submit a petition application with the Department of Homeland Security, U.S. Citizenship and Immigrations Services (USCIS). Necessary application fees are to be settled in order to facilitate the process of the petition. Other prerequisites needed include the employee’s passport, birth certificate, and certificate of eligibility, medical examinations and many others.
