Immigration Petition for Parents

US citizen children are the only ones eligible to petition their parent(s) to live with them permanently in the United States of America. In order to be file for a petition, the child must be 21 years of age.

Here are the procedures for immigration petition for parents:

1. Fill up Form I-130 or the Petition for Alien Relative. You should fill up separate petitions for each parent

2. Prepare a copy of your birth certificate showing names of you and your parents

3. Your US citizen passport and/or copy of your Certificate of Naturalization if you were not born in the US

4. Any previous marriages, annulment or divorce decrees entered into by your parent/s must also be prepared

5. Prepare a copy of your parents’ marriage certificate

If you are an illegitimate child but you want to file a petition for your father, you can follow numbers 1 to 3 above and provide evidence that there is an emotional or financial bond relationship between you and your father, for instance, through financial support receipts, remittances, letters, pictures, school records, insurance before you reach the age of 21.

If you were born out of wedlock but legitimated and you want to file a petition for your father, you can follow numbers 1 to 3 above and provide evidence that you were legitimated before your 18th birthday.

If you are petitioning a stepparent, you need to follow numbers 1 to 4 above. In addition, prepare a copy of the civil marriage certificate of your birth parent to your stepparent that shows the marriage occurred before your 18th birthday.

If you are petitioning an adoptive parent, follow numbers 1 to 4 above. In addition, present a certified copy of the adoption decree that shows you have been adopted before your 16th birthday and a sworn statement showing the detailed places and dates you have lived with your parent.

Additional requirement applies if anyone has his/her name changed. Proof of the name change should also be provided.
