Employers who wish to file an immigrant or nonimmigrant worker petition for alien employees should accomplish the necessary forms indicated below depending on the category or purpose of the petition. The list also includes forms for entrepreneurs who wish to immigrate to the US.

Form I-129 – Petition for a Nonimmigrant Worker
Used by employers who wants to petition alien workers to the US on a temporary basis for their services, training, extension or change of status. (H-1B, H-1C, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1 nonimmigrant worker.

Used by employers for L-1 nonimmigrant employees under a blanket L petition

Used for application of a travel document, re-entry permit, refugee travel document or advance parole.

Form I-134 – Affidavit of Support
Used as a proof that visa applicants have sponsorship while in the United States. A separate affidavit is required per applicant.

Form I-140 – Immigrant Petition for Alien Worker
Used by an employer for an alien worker who wants to permanent reside in the US.

Form I-360 – Petition for Amerasian, Widow(er), or Special Immigrant
Used to classify aliens as Amerasian, Widow or Widower or Special immigrant.

Form I-526 – Immigrant Petition by Alien Entrepreneur
Used by an entrepreneur who wishes to immigrate to the United States.

Form I-566 – Interagency Record of Request — A, G or NATO Dependent Employment Authorization or Change/Adjustment to/from A, G or NATO Status
Used in addition to the application for dependent employment authorization as an eligible A-1, A-2, G-1, G-3, G-4, or NATO 1-6 dependent and as any application for a change or adjustment of status to, or from, A, G or NATO status.

Form I-765 – Application for Employment Authorization
Used by certain aliens who are authorized to temporarily work in the United States

Form 829 – Petition by Entrepreneur to Remove Conditions
Used by a conditional permanent resident who acquired such status through entrepreneurship to remove the conditions on his or her residence.

Filing Fee :
$2,850 plus a biometrics fee of $80. An additional biometrics fee of $80 must be paid for each conditional resident dependent, listed under Part 3 or Part 4 of Form I-829.

Form I-864 – Affidavit of Support Under Section 213A of the Act
Used to present enough financial support by the applying immigrant. This proves he/she will not become a dependent while staying in the United States.

Filing Fee :
Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad.

Form I-864A – Contract Between Sponsor and Household Member
Used for the benefit sponsored immigrant and any agency of the Federal Government, any agency of a State or local government, or any private entity to which the sponsor has an obligation under the affidavit of support to reimburse for benefits granted to the sponsored immigrant. This contract may be enforced in any court with appropriate jurisdiction. By signing this form, a household member who is not a sponsored immigrant, agrees to make his or her income and/or assets available to the sponsor to help support the immigrant for whom the sponsor has filed an affidavit of support.

Form I-864EZ – Affidavit of Support Under Section 213A of the Act
Used to present enough financial support by the applying immigrant. This proves he/she will not become a dependent while staying in the United States.

Form I-864P – Poverty Guidelines
Used to determine the minimum income requirement needed to complete Form I-864, Affidavit of Support under Section 213A of the Immigration and Nationality Act.

Form I-864W – Intending Immigrant’s Affidavit of Support Exemption
Used to present that applicant is exempt from the Form I-864 requirements.

Form I-865 – Sponsor’s Notice of Change of Address
Used to report a sponsor’s new address and/or residence, as required by 8 U.S.C. 1183a(d)

Form I-9 – Employment Eligibility Verification
Used by all US employers for each person they hire for employment in the US. This covers citizens and non-citizens. The form requires the employer to verify the authenticity of the employees’ identity records and documents as well as his/her employment eligibility.

Used by an organization to apply for authorization to issue certificates to health care workers.
