Guide for US Citizens Getting Married in China

US citizens getting married in China are required to follow the marriage registration procedures as mandated by the Marriage Law of the People’s Republic of China. Each jurisdiction has its own local civil affairs office that a marrying couple can contact for particular details.
The legal marrying age must be met before any couple may be accepted to get married in China. Men’s acceptable age should be 22 while for women it should be 20. It is still best to inquire with the local civil affairs office regarding the accepted age as it may vary depending on each area. Proof of eligibility to contract marriage will be required as well for this will assure both the man and the woman are qualified to marry.
For the basic requirements, here are some of the things a US citizen should prepare for:
1. Valid US passport with a valid Chinese visa.
2. Pay registration fee.
3. Secure Affidavit of Marriageability. This legal document is a written affirmation that the US citizen is legally able to get married.
>> should the US citizen been married previously, he/she must present original and photocopies of divorce or annulment decrees; in the case of death of spouse, a death certificate must be presented.
4. Photos of the US citizen and his/her Chinese partner, taken together
5. Other requirements may include other valid ID’s for both the marrying couples.

Marriage to a US citizen does not mean automatic citizenship for any foreign spouse. The US citizen spouse may immediately file for an immigrant petition for his/her Chinese spouse with the USCIS soon after the marriage is done.
