Visa Fraud Through Marriage to a US Citizen

Marriage to a US citizen is undeniably one of the easiest ways to gain permanent residency status in the US. This is a fact that everybody knows and has rampantly being used as a way to avoid lengthy petition processes that can be acquired by other legal means available. Perhaps, this is the first thing that comes to mind to a foreign national whose ulterior motive is to live his/her “American dream”.

The world views the United States of America as the land of the free, the land of milk and honey and where there are greener pastures. All these beliefs are evident with the country’s global standing. Many people want to live in a first world country where the government takes care of its people, a country with efficient implementation of laws and policies. The US is a nation whose economic strength is far better than others in spite of the financial crisis that looms across the globe up until now. This is how many foreign nationals often look at US and perhaps how their dream of going here started to build up way earlier in their lives.

In recent times, many desperate moves have been made in order for a person to penetrate the US. Yes, even entering through fraud marriages is widespread. Men and women are tempted to do such a thing in place of a better future in the US. They allow themselves to marry someone not out of love but out of personal desires or sometimes, out of what their families want them to do. However, marriage to a US citizen for green card is not a completely guaranteed way to live permanently in the US. There are certain processes which may eventually reveal the sham marriage.

Immigration officers are aware that sham marriages exist which is why they are determined to pursue these people. Many applicants can attest that during an interview with an immigration officer, they were asked about personal and intimate questions about their relationship as husband and wife. Interviews required such as these exposes the nature of the marriage even through simple questions which often caught a couple off guard. Notwithstanding the fact that even couples in valid marriages may be inconsistent with their answers, other methods are being used like the behavior of the couple towards each other and documentation showing proof of their co-habitation.

There is only a certain threshold that a fraud marriage can survive before authorities will soon discover about it. When this happens, the couple may expect worse consequences for doing so. It is only right to enter a marriage out of love and pure intentions and not because a green card is at hand.
